Terms

This Personal Training Agreement is made between Pious Strength (the Trainer) and the individual named at checkout (the Client).

The Client agrees that the Trainer will provide personal training sessions as agreed upon between the Trainer and the Client, which may include but is not limited to: an initial assessment, customised workouts, in-person sessions, and support and communication.

The Client agrees to pay a weekly fee of an agreed amount, billed automatically from the date of purchase. Payments are processed via Stripe. The Client authorises automatic weekly billing for the duration of this Agreement. Payments are non-refundable, including for missed or unused sessions. The Client is responsible for ensuring that payment details are current and that sufficient funds are available. Failed payments may result in service suspension until payment is resolved.

The Client agrees to a minimum commitment of twelve (12) weeks from the date of their first training session. Early termination of this Agreement by the Client before the end of the twelve-week period will result in the Client being liable for the remainder of the agreed fees for the full commitment period. This clause ensures the Client's accountability and consistency in reaching their fitness goals, and allows the Trainer to plan and allocate time accordingly. After the initial twelve-week period, the subscription will continue on a week-to-week basis unless terminated by the Client with fourteen (14) days written notice.

The Client must give at least 24 hours notice to cancel or reschedule a session. Cancellations made with less than 24 hours notice will be charged in full and will not be rescheduled, except in cases of emergency at the Trainer's sole discretion. The Trainer will provide reasonable notice if a session must be rescheduled. Repeated cancellations or no-shows may result in the termination of this Agreement at the discretion of the Trainer.

The Client acknowledges that it is their responsibility to reschedule sessions based on the Trainer's availability. Any rescheduled sessions must occur within the same billing cycle and cannot be carried over into future cycles. Pious Strength is dedicated to supporting the Client's goals and will strive to offer flexibility wherever possible.

The Client acknowledges they are voluntarily engaging in physical activity and understands the risks involved, including but not limited to injury, strain, and fatigue. The Client confirms they are in good physical condition, have no undisclosed medical or physical conditions that would limit participation, and have obtained medical clearance if required. The Client agrees to promptly notify the Trainer of any changes to their health or physical condition that could affect their ability to train safely. The Trainer may decline to conduct sessions if there is reasonable concern regarding the Client's health or safety, until proper clearance is obtained.

The Client agrees that this Agreement may be terminated after the initial twelve-week period with a minimum of fourteen (14) days written notice. The Trainer reserves the right to terminate this Agreement immediately for non-payment, misconduct, repeated no-shows, or if the Client's actions create a risk to themselves or others. Any outstanding balance at the time of termination remains payable in full. If termination occurs before the twelve-week commitment is fulfilled, the Client is liable for the remaining amount due.

These terms apply to prepaid sauna sessions purchased from Pious Strength, used at Warehouse Fitness, Wollongong.

Sessions are sold in packs. Each prepaid session entitles you to one sauna session of the advertised length. A prepaid session carries no monetary value: it is not a store credit or account balance, cannot be redeemed against any other product or service offered by Pious Strength, cannot be exchanged for cash, and is not transferable to another person.

The single session price is $25. Session packs are offered at a genuine discount against that price: the 5 session pack is $100 ($20 per session, a 20% discount) and the 10 session pack is $170 ($17 per session, a 32% discount). Because packs are supplied at a genuine discount, sessions are valid for 12 weeks. The expiry date is shown at checkout and on your account page at all times. Unused sessions are forfeited at expiry.

Where sessions are purchased before the sauna opens to the public, the 12 week period runs from the opening date rather than the date of purchase, so that no session expires before it could be used. The applicable expiry date is shown on your account page.

Sessions are booked through the online booking page. Bookings are subject to availability and can be made up to four weeks ahead. One session is deducted when you book, not when you attend.

You may cancel a booking up to 24 hours before the session start time, and the session will be returned to your account. Cancellations made with less than 24 hours notice, and failure to attend a booked session, will use the session. Sessions returned by cancellation remain subject to the original expiry date of the pack they came from.

If Pious Strength cancels your session — equipment failure, maintenance, illness, or any other reason — your session is returned in full. If the sauna is unavailable for an extended period, the expiry date on affected sessions will be extended by at least the length of the closure.

You must be 18 or over to use the sauna unaccompanied. You use the sauna at your own risk and confirm you have no condition that makes heat exposure unsafe for you. You should seek medical advice before using an infrared sauna if you are pregnant, have a heart condition, low or high blood pressure, diabetes, or any condition affecting how your body handles heat, or if you are taking medication that affects heat tolerance or hydration.

Do not use the sauna while affected by alcohol or drugs. Do not use it if you are unwell or have an open wound or skin infection. Leave the sauna immediately if you feel dizzy, faint, nauseous or unwell at any point, and tell staff.

You are asked to shower before use, sit on a towel, and leave the cabin as you found it. Pious Strength may refuse or end a session where there is a reasonable concern for your health and safety or that of others, and may cancel remaining sessions and refund them where a person's conduct makes continued use unsuitable.

Pious Strength is operated by Sura Katz, ABN 14 811 408 041, at Warehouse Fitness, Wollongong, New South Wales.

Part A applies only to clients who have purchased a personal training plan. Part B applies only to those who have purchased prepaid sauna sessions. Purchasing one does not bind you to the terms of the other, and the two are billed and managed separately.

Your personal and health information is handled in accordance with our privacy policy, which forms part of these terms.

These terms represent the entire agreement between Pious Strength and you in respect of what you have purchased, and supersede all prior discussions, representations, or agreements, whether written or spoken.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. If a service is not supplied with due care and skill or is not fit for purpose, you may be entitled to a remedy under that law regardless of anything stated here.

These terms may change. The version number and date at the top of this page will change with them, and the terms that applied when you purchased continue to apply to that purchase.
